Recommendations VІІI International Conference Protection of Democratic Values and Compliance with Human Rights in the Activity of Security Services

(Lviv, Ukraine, 26 May 2016)

In the course of the International Conference with the agenda Formation and Development of Security Services: Eastern European and Ukrainian Experience the participants

discussed the issue of social transformations in the late 20th – beginning
of 21st century in the countries of Eastern Europe and their impact on the development and reform of security services;

agreed that the integration of the Eastern European states into the NATO and EU were the key factors of these processes; at the same time, the models of the reform of the internal security sector were determined, first of all, by the political and legal realities and historical and cultural traditions of each of the states, which led to a variety of approaches to outline the competence of security services
in the Eastern European countries; 

recognized that the complex of present threats to the national security
of Ukraine, the most critical of which are the aggression of the Russian Federation and corruption in Ukraine, is a danger to the existence of the Ukrainian state;

underscored that the key factor, which determines the necessity to reform the SSU, is the need to ensure sustainable development of Ukrainian society,
the precondition of which is the adherence to the rule of law, including in the context of the activity of a security service, which should serve the people of Ukraine, protect their rights and respect their freedoms, observing the legality and equal treatment of all citizens;

defined that the objective of the reform of the SSU is the creation
of an effective, dynamic and flexible security service, staffed with highly professional specialists, equipped with up-to-date logistics and technical means, able to adequately respond to present-day challenges and threats to the state security of Ukraine;

stressed that the reform of the SSU must be carried out taking into account the priority of rights and freedoms of an individual, principles of the rule of law, non-partisanship, transparency and openness for democratic civil control,
in coordination and interaction with other entities of the security and defence sector of Ukraine and taking into consideration the best practices of development of the security services in the EU and NATO states;

came to the conclusion that the reform of the SSU should include
the fulfillment of the following tasks:

increasing the institutional capacity of the SSU as a specially empowered state body in the area of counterintelligence activity and state secret protection, the main agency in the state-wide system of counteraction to terrorism;

delineation of the functional tasks and powers of the SSU and other law enforcement and state agencies in the area of countering corruption and organized crime, pretrial investigation; ensuring the protection of the interests of the state in the economic, informational and cyber areas;

establishing an optimal correlation of military and civil positions in the structure of the SSU according to the changes in the security environment of Ukraine;

introducing an effective mechanism of personnel provision in the SSU system, improving the system of training of personnel for the needs of SSU, ensuring the proper level of social and legal protection of the SSU employees;

improving procedures of financing and logistical support of the activity
of the SSU;

introducing effective mechanisms of democratic civil control over
the activity of the SSU;

and upon the results of the Conference recommended:

when developing the main outlines of the SSU reform, to take into consideration the legal models and experience of the Eastern European and Baltic states in the area of building up the internal security sector; when defining the competence of the SSU to proceed from the legal and security realities, historical and cultural traditions of Ukrainian society;

based on the SSU Reform Concept and recommendations of this Conference, to prepare a Plan of Implementation of the Concept and drafts of changes and amendments to legal acts regulating the SSU activity. To involve leading national and international experts of security and defence sectors, representatives of NGO’s, members of the Civil Council under the SSU into this work and carry it out in close interaction with the Verkhovna Rada of Ukraine, in particular the relevant committee;

to stipulate a minimum 5-year transitional period to ensure effective implementation of the Concept of the SSU Reform;

to establish a body responsible for monitoring reform during this period;

to intensify the efforts to inform the public on the results of the SSU activity, in particular to plan jointly with the EUAM Ukraine a publication of an Annual Report on the SSU activity in 2016;


the Office of the National Security and Defence Council of Ukraine and the Verkhovna Rada of Ukraine Committee on National Security and Defence:

to study the expediency of establishing additional forms of control over the SSU by the Verkhovna Rada of Ukraine through the creation of an independent parliamentary oversight body to control and check any type of SSU activity. This body may include specialists in the area of security and defence, who are not people’s deputies, have high professional level and authority in the society. The revised system of control and oversight over the SSU activity should ensure strict adherence by the SSU of the legal principles of its activity, compliance with citizens’ rights and freedoms, national and international legislation in the area of protection of human rights.

to support the development and adoption of the laws necessary to reform
the SSU.
