Improvement of legislation on countering threats to national security in information sphere is needed to block Russian cyber attacks, SBU says
The SBU supports draft law “On amendments to certain legislative acts of Ukraine on countering treats to national security in information sphere”, currently being reviewed in the Verkhovna Rada of Ukraine.
The SBU holds that the amendment of current legislation in the field of information security and cybersecurity will ease legal bottlenecks in blocking information resources (services) based on the decisions of an investigative judge and a court, in criminal proceedings. Blocking could only be possible by the decision of the National Security and Defense Council of Ukraine, adopted in accordance with the Law of Ukraine “On Sanctions”. Russia’s usage of latest technologies in their hybrid war against Ukraine has transformed the information sphere and cyberspace into one of the key battle-spaces.
Since 2014, numerous cyberattacks with the use of malicious software targeted data of critical infrastructure objects and government agencies. The cyberattacks launched by the Russian secret services caused a temporary disruption of energy supply, creating preconditions for technogenic emergencies, brought down dozens of servers and electronic systems, blocked the system of budget payments and banking and administrative services.
During five months of 2018, the SBU detected and documented that the Russian special services have used 181 Internet resources for destabilisation of social and political situation in our country and for manipulation of the public opinion. SBU materials helped to put these resources pm the sanction list following the latest decision of the National Security and Defense Council of Ukraine.
Every day the SBU Cyber-Security Center (24/7) is detecting cyber threats and cyber attacks, records thousands of IP addresses and other data from information resources used to launch cyber attacks from the Ukrainian territory.
We stress that the legal mechanism provided by the draft law empowers the SBU to take measures for cyber defense of information critical infrastructure objects and to block the further spread of a computer virus on the territory of the state.
Stipulated by the draft law, monitoring of access to the Single Register of Execution of Court Decisions, application of sanctions in the field of telecommunications, existence of a transparent procedural decisions on temporary blocking of access to information resources (services) will provide democratic civilian control over the SBU actions, for stronger national security of Ukraine. Also, in accordance with the adopted Law of Ukraine “On National Security of Ukraine”, there will also be a parliamentary control over the activities of the security and defense sector bodies.
The SBU emphasizes that the adoption of the draft law will provide legal support to the SBU activities for the effective fulfillment its main tasks in the field of information security and cybersecurity of Ukraine as set out in the law.
