SBU jointly with DBR exposes raiders in takeover of business and UAH 10 million extortion

The officials of the SBU and the DBR exposed the unlawful activities of the group of individuals who organized forcible takeover of property and property rights of the owner of granite quarries in Zhytomyr and Poltava regions amounting to UAH 230 million.

Law enforcers found that for the purpose of forcible takeover, the group members involved the official of the State Service of Geology and Subsoil of Ukraine, as well 

as other officials of the controlling and law enforcement agencies. The security officials documented that from December 2018 till June 2019, deliberately groundless transactions were committed to seize the enterprise: the registration actions were entered into the Unified State Register of Legal Entities using false documents, in particular seals and stamps of the enterprise.

For the return of one of the granite quarries from the owner of the business, the offenders demanded UAH 10 million. Within the framework of initiated criminal proceedings under Part 4 of Art. 189, part 3 of Art. 206-2, part 4 of Art. 190 of the Criminal Code of Ukraine law enforcement officers documented that the organizers of the mechanism illegally seized private property and demanded from the businessman USD 390 000 for the return of property, threatening to transfer it to third parties. They also demanded USD 30 000 for the renewal of the license for the extraction of mineral resources and the issuance of an act of inspection of the quarry by the representatives of the State Service of Geology and Subsoil of Ukraine without any detected violations. During the pre-trial investigation it was established that officials of the State Service of Geology and Subsoil of Ukraine, through inspections in the sphere of subsoil use, exerted pressure on the representatives of the enterprise in order not to resist forcible takeover. In early June 2019, law enforcement officers detained two participants of the raider scheme while receiving USD 390 000 for the return of the business and USD 25 000 for "resolving issues" with the officials of the State Service of Geology and Subsoil of Ukraine. Two other members of the group were detained later.

"A good example of the joint work of the SBU and the DBR," said acting SBU Head Ivan Bakanov. "The joint work of the DBR and the SBU proved that it is possible to protect entrepreneurs, establish justice and bring the perpetrators to justice, even if the perpetrators extended their influence to law enforcement and public bodies. DBR is an ally for everyone who protects entrepreneurs and the law ", - said director of DBR Roman Truba. In total, ten searches were conducted in Kyiv and in two regions of Ukraine, in particular, in the Head of the State Service of Geology and Subsoil of Ukraine, in the Central Interregional Department of the State Geological Survey of the State Service of Geology and Subsoil of Ukraine, and in one of the banks where the raiders received money.

More than 70 officials are involved in the implementation of this proceeding: the investigators of the DBR in Khmelnytskyi city; operative officers of the SBU's military counterintelligence; procedural heads of the General Prosecutor's Office of Ukraine; officials of the SBU special-purpose unit "Alpha".
