SSU e-response features

Algorithm of the Ukrainian security service's electronic response to the lack of information on the implementation of the bans provides for the digital signature by authorised person. (http://lustration.minjust.gov.ua/main/question)

According to the Paragraph 29 of the Procedure for verification of credibility of information on the application of bans stipulated by Part 3 and Part 4 Article 1 of the Law approved by the resolution of the Cabinet of Ministers of Ukraine No. 563 dated 16 October, 2014, the Security Service of Ukraine being an inspection body shall provide the responses on the availability or lack of information on implementation of ban stipulated by Parts 3 and Part 4 Article 1 of the Law.

The Security Service of Ukraine shall provide responses to requests regarding persons who furnished misleading information in paper form under the handwrit-ten signature of an authorised SSU official.

The Security Service of Ukraine will provide responses on the lack of infor-mation on the implementation of the bans stipulated by Part 3 and Part 4 Article 1 of the Law in e-form using SSU official digital signature.

The responses will be submitted in the e-file form with the extension "*.p7s". Af-terwards, it will be sent from the email box lustration@ssu.gov.ua to the e-mail addresses of the requesters. If the email address in the request is missing, the SSU will respond to the email address of a public authority, self-governance body, institution or organisation of Ukraine of the highest level.

Legal grounds for ensuring e-responses by using SSU official digital signature are provided by the Law of Ukraine On Electronic Digital Signature; the Law of Ukraine On Electronic Documents and Electronic Document Circulation; the Pro-cedure for the use of electronic digital signature by public authorities, self- gov-ernance bodies, enterprises, institutions and state-owned organisations, approved by the Cabinet of Ministers of Ukraine No 1452 of 28.10.2004; Procedure for working with electronic documents via the system of electronic interaction of ex-ecutive authorities with the use of digital signature, approved by the resolution of the Ministry of Justice of Ukraine No 1600/5 of 01.11.2012, registered by No 1854/22166 of 05.11.2012 in the Ministry of Justice of Ukraine; Procedure for working with e-documents within record-keeping and preparation for archiving, approved by the resolution of the Ministry of Justice of Ukraine No 1886/5 of 11.11.2014, registered by No 1421/26198 of 11.11.2014 in the Ministry of Jus-tice of Ukraine (hereinafter Procedure-1886/5).

After receiving an SSU email response prescribed by the Law On Lustration:

1) The person should check the credibility (makes sure of data integrity) of the digital signature by using the Internet resource of the State Enterprise "National information systems" of the Accredited Certification Center for the Key of Ukraine's Justice Authorities referred to the link https://ca.informjust.ua/verify (section "Check EDS") or by using software that can be downloaded from the Internet resource of the State Enterprise "National Information Systems" of Accredited Certification Center for the Key of Ukraine's Justice Authorities referring to links https://ca.informjust.ua/download/Soft/EUInstall_for_CA_Informjust.exe; https://ca.informjust.ua/download/docs/EU13OManual_NAIS.pdf (Opera-tor Guide)

2) A person should create a paper copy of an e-document by making (print-ing) it on paper along with all the details required for this type of document in compliance with the legal procedure for its placement, as well as with other available optional props.

A person marks "According to the original" in the middle of the lower field of the front side of the form with details (if any) and on the first page of each input printed e-document. The employee responsible for the record-keeping prepare the document with hard copy and exemplified by personal signature (Para. 6 of the Chapter IV of the Procedure-1886/5).
