Who is a whistleblower?

A whistleblower is an individual who reports possible instances of corruption, corruption-related offences, or other violations of the Law of Ukraine On the Prevention of Corruption committed by another person, believing the information to be true and reliable.

To qualify as a whistleblower, the information must have come to the individual’s attention in connection with their employment, professional, business, civic or academic activities, service, studies, or participation in legally prescribed procedures required to commence such activities, to service or study.

A person is considered a whistleblower if all of the following conditions are met:

  • they reasonably believe the reported information is true and reliable;
  • the report concerns possible corruption offences, corruption-related offences, or other violations of the Law of Ukraine On the Prevention of Corruption; and
  • the information was obtained in connection with their employment, professional, business, civic or academic activities, service, or studies.

In accordance with Article 53³ of the Law of Ukraine On the Prevention of Corruption, a whistleblower has the right to:

  • be informed of their rights and obligations under the Law;
  • submit evidence in support of their report;
  • receive confirmation that their report has been accepted and registered by the competent authority;
  • provide explanations or evidence, or decline to do so;
  • receive free legal aid in matters relating to the protection of their rights as a whistleblower;
  • confidentiality;
  • report possible instances of corruption or corruption-related offences, or other breaches of this Act, without disclosing any personal details (anonymously);
  • receive personal protection measures, where provided by law, if there is a threat to their life or health, or to the life, health, property, or home of their close relatives, or to refuse such protection;
  • reimbursement of expenses incurred in protecting their rights, including legal costs and court fees, where provided by law;
  • receive a reward in cases established by law;
  • receive psychological support;
  • be exempt from legal liability in cases provided for by law; and
  • receive information on the progress and outcome of the review, verification, and/or investigation of their report.
