Prevention of Conflicts of Interest
The Law of Ukraine On the Prevention of Corruption distinguishes between two types of conflicts of interest:
- Potential conflict of interest – a situation in which a person has a private interest in the area where they exercise their official or representative powers, and this interest may influence the objectivity or impartiality of their decision-making, or their actions or omissions while performing those powers;
- Actual conflict of interest – a situation in which a person’s private interest conflicts with their official or representative powers and does influence the objectivity or impartiality of their decision-making, or their actions or omissions while performing those powers.
